Privacy Policy for customers and suppliers issued by Coswell S.p.A. in accordance with art. 13 of European Regulation 2016/6
This Privacy Policy has been drafted and
issued in accordance with Article 13 of the European Regulation 2016/679
(hereafter referred to simply as the European Regulation), which has introduced
significant regulatory changes. This Privacy Policy therefore updates and
replaces any previous versions issued previously. Given that, it should be
noted that:
1) as a result of the establishment of our
business relationship and during the course of the same, our company will need
to collect and process your personal data; 2) for the sake of clarity, we
hereby specify the following definitions stipulated in the aforementioned
European Regulation:
Personal data: means any information relating to an identified or
identifiable natural person (‘data subject’); an identifiable natural person is
one who can be identified, directly or indirectly, in particular by reference
to an identifier such as a name, an identification number, location data, an
online identifier or to one or more factors specific to the physical,
physiological, genetic, mental, economic, cultural or social identity of that
natural person;
Processing: means any operation or set of operations which is
performed on personal data or on sets of personal data, whether or not by
automated means, such as collection, recording, organisation, structuring,
storage, adaptation or alteration, retrieval, consultation, use, disclosure by
transmission, dissemination or otherwise making available, alignment or
combination, restriction, erasure or destruction.
So, in accordance with Article 13 of the
European Regulation 2016/679,
we hereby inform you
that the collection and processing of your
personal data shall be conducted by the undersigned company in compliance with
the following:
a)
purposes: data shall be processed in order to properly conduct accounting, fiscal,
commercial and technical obligations and all company activities related to this
current relationship;
b)
advertising purposes: data may also be used, following your specific and
explicit consent, to send advertising material/communications by post, e-mail,
telephone, fax, text message and other similar means; having expressed your
consent, you still have the right to object, at any time and without charge, to
the processing of your data for this purpose;
c)
legal basis: the legal basis for processing may be constituted by the
consent given for specific purposes, or, as applicable, by the need to execute
a contract or pre-contractual measures adopted at your request;
d)
methods: the data shall be processed using both paper-based and
electronic/computer/telematic tools/supports, in full compliance with the law,
according to principles of lawfulness and fairness and in a way that protects
your privacy;
e)
optional data provision: providing data is optional and not mandatory;
f)
consequences of refusal: refusing to provide your data or opposing their
processing may make it impossible to continue any commercial or other
relationship with our company; whereas, denying the use of data for sending
advertising material/messages will have no consequences on present or future
relationships;
g)
subjects or categories of subjects (recipients) to whom
the data may be communicated or disseminated: the data may be communicated to third parties only in
order to fulfil legal or contractual obligations. Data shall not be
disseminated under any circumstances
h)
persons authorised to process data: data shall be processed exclusively by specially
authorised company employees from the administrative and commercial sectors;
i)
automated decision-making processes (e.g. profiling): no automated decision-making processes are used;
j)
rights of the data subject: you have all the rights enshrined in the European
Regulation, such as the right to request access to your personal data, the
right to rectify, delete and restrict processing of it, the right to oppose it
being processed, and the right to data portability. You also have the right to
lodge a complaint with the Supervisory Authority;
k)
transfers to third countries: any transfer of personal data to a third country outside
the European Union or to an international organisation shall take place on the
basis of an adequacy decision made by the Commission or, in the case of
transfers pursuant to Articles 46, 47 or 49, second paragraph, of the European
Regulation, on the basis of appropriate and adequate safeguards;
l)
data retention period: data shall be retained for the period of time strictly
needed to meet the data subject's requests or in accordance with the provisions
of current legislation or any contractual clauses;
m)
data controller: the data controller is Coswell S.p.A., with registered
office in Funo di Argelato (BO), Via P. Gobetti n. 4, here represented by its
pro tempore legal representative;
n)
data protection officer: the data protection officer is Dr. Juri Torreggiani,
with registered office in Reggio Emilia, Via Piccard n. 16/G, tel.
0522/30.11.69, fax 0522/38.79.96: any request for clarification or information
may be addressed to this officer.
This Privacy Policy may be supplemented,
orally or in writing, with further elements and indications, in order to better
satisfy any need you may have for information regarding “Privacy” issues and to
comply with regulatory developments.
